Unpaid Overtime and Penalties Cost NJ Company Over $711,000
February 9, 2022A federal court ordered an electrical, heating, ventilation, and air conditioning company and its co-managers to pay over $711,000 to 89 workers who were denied overtime wages.
In addition to unpaid wages, FTR Electrical Mechanical Contractors, Inc., based in Union, New Jersey, was charged with over $16,000 in civil money penalties and interest for willful violations of the Fair Labor Standards Act, a Department of Labor (DOL) announcement stated Wednesday.
The DOL said that during an investigation by the department’s Wage and Hour Division, it was found that the company and its co-managers deliberately denied overtime pay to the workers, who were electricians, electrician helpers, and HVAC technicians. The defendants were charged for the following:
- Paid straight-time for hours worked over 40 each week.
- Required employees to work off the clock and did not pay them accordingly.
- Required employees to clock in, but directed them not to clock out when they finished working.
- Paid employees for a maximum of eight hours each workday, regardless of how many hours they actually worked.
- Failed to maintain accurate records of employees’ hours worked and total wages paid.
